Granted

Core Planning Reasoning

The proposed development was refused due to significant deficiencies in the public wastewater infrastructure network, rendering the project premature, and because the proposed road access on Hickey's Lane was deemed a traffic hazard contrary to DMURS standards.

Decision Maker's Conclusion

  • The development is premature pending the required upgrades to two wastewater pumping stations and a 570m network extension, which are currently not planned by Uisce Éireann.
  • The proposed access strategy for Hickey’s Lane, utilizing a 3.7m wide stop-go shuttle system for an 85m stretch, is substandard and would interfere with the free flow of traffic and endanger public safety.
  • In the absence of a Natura Impact Statement (NIS), it cannot be determined that the development would not have a significant adverse effect on the Malahide Estuary SPA and SAC due to potential wastewater overflows.
