Refused

Core Refusal Reason

The application for an extension of duration was refused because no substantial works had commenced on-site within the original permission period, and legislative changes no longer allow extensions for un-commenced developments.

Decision Maker's Conclusion

  • A site inspection conducted on 27th January 2022 confirmed that no physical works have commenced on the site in respect of the permitted development to date.
  • The Planning and Development (Amendment) Act 2021 removed the provision (Section 42(1)(a)(ii)) that previously allowed for the extension of duration for developments where substantial works had not been carried out.
  • The Planning Authority is not satisfied that substantial works have been or will be carried out pursuant to the permission within the appropriate period as required by Section 42(1)(a) of the Planning and Development Act 2000 (as amended).
