Core Planning Reasoning

The Inspector recommended granting permission (and omitting a restrictive condition) on the basis that the modifications for retention are minor, sympathetic to the Z2 conservation zoning, and do not cause significant adverse impacts on the residential or visual amenities of the area.

Decision Maker's Conclusion

  • The retention of the modifications, including a 450 mm height increase and second-floor setback, is acceptable in terms of the Z2 zoning and does not adversely affect the residential or visual amenities of the area.
  • The height increase is relatively modest and, based on the applicant's daylight/sunlight assessment, does not give rise to significant overshadowing or loss of light for neighboring properties.
  • Condition No. 2 of the Planning Authority's decision should be omitted as the description in public notices was adequate and the setback element does not negatively impact visual amenity.
