Refused

Core Refusal Reason

The proposed development requires the removal of over 135m of mature roadside boundary (embankment, hedgerow, and trees) to achieve sightlines, which would negatively impact the area's ecology, visual amenity, and rural character.

Decision Maker's Conclusion

  • The removal of approximately 135m of mature roadside boundary to facilitate a safe entrance is considered excessive and would result in an unacceptable impact on the local ecology and visual amenity.
  • The applicants failed to provide a valid justification for not relocating the dwelling to an alternative site to the east, which might have mitigated the need for such extensive boundary removal.
  • The proposal contravenes Objective KCDP 11-27 of the Kerry County Development Plan 2022-2028, which seeks to preserve and enhance broadleaf tree cover and ensure developments retain existing trees.
