Core Refusal Reason
The application for an Extension of Duration was refused because development had not commenced on-site and substantial works had not been carried out, failing to meet the mandatory statutory requirements of Section 42 of the Planning and Development Act 2000.
Decision Maker's Conclusion
- A site inspection confirmed that no physical development has commenced on the subject site to date.
- The applicant failed to meet the requirements of Section 42(1)(c)(i) and (ii) of the Planning and Development Act 2000, which necessitate that development must have commenced and substantial works be carried out before an extension can be granted.
- As the statutory criteria for an extension of duration were not satisfied, the Planning Authority determined that an extension of time could not be permitted.
