Bogue Pigs Unlimited Company intend to apply for planning permission to; A. Demolish /decommission 13 No. existing pig houses, 5 No. additional modular type pig houses and 1 No. store (Ref. 2-5 and 8-22 inclusive) and B. construct 5 No. replacement pig houses, an extension to 1 No existing pig house, and, 1 No. general purpose store, together with all ancillary structures and all associated site works arising from the above proposed development, and, in lieu of developments previously approved under planning Ref. 24/60324, at Ballinrink, Oldcastle, Co.Meath. An Environmental Impact Assessment Report (E.I.A.R.) relating to this proposed development will be submitted with this planning application. Significant Further Information/Revised Plans submitted on this application.
Core Refusal Reason
The Planning Authority issued a request for Further Information (rather than a final refusal) due to a fundamentally substandard Environmental Impact Assessment Report (EIAR) and the omission of critical documentation, including a site layout plan.
Decision Maker's Conclusion
- The submitted Environmental Impact Assessment Report (EIAR) is unacceptable as it fails to comply with EPA Guidelines, lacks site-specific mitigation measures, and does not adequately assess the 'do-nothing' alternative.
- The absence of a proposed site layout plan and detailed topographical surveys prevents the Planning Authority from making a full assessment of the design, layout, and physical impact of the development.
- Significant concerns remain regarding potential hydrological links to the Lough Sheelin SPA, necessitating a revised Appropriate Assessment Screening and potentially a Stage 2 Natura Impact Statement (NIS).
