Core Planning Reasoning
The Inspector recommended upholding the financial contribution condition because the development falls within the 'Industrial/Commercial' category of the Dublin City Council Development Contribution Scheme 2023-2026 and does not qualify for any specific exemptions listed under the scheme.
Decision Maker's Conclusion
- The Dublin City Council Development Contribution Scheme 2023-2026 categorizes development into only two classes: residential or industrial/commercial; the subject proposal is found to fall into the latter as an industrial use.
- The applicant is not considered a statutory undertaker as per the definition in the Planning and Development Act 2000, and the proposal does not meet the criteria for exemptions or reduced contributions under Section 10 of the scheme.
- The Planning Authority correctly applied the terms of the scheme, and Condition No. 2, requiring a payment of €659,178.80, should be attached to the grant of permission.
