Refused

Core Refusal Reason

The application was refused due to significant technical deficiencies regarding environmental protection (SAC/SPA/WFD), inadequate drainage and flood risk assessment, poor road safety design, and failure to demonstrate the functionality of public open space.

Decision Maker's Conclusion

  • The applicant failed to provide sufficient hydrogeological and hydrological evidence to rule out adverse impacts on the integrity of the Lough Rea SAC and SPA and to ensure compliance with the Water Framework Directive.
  • The proposed drainage strategy and flood risk assessment were deemed inadequate due to failed soakaway tests, insufficient attenuation for extreme storm events, and unjustified assumptions regarding culvert blockages.
  • The development failed to meet basic standards for road safety and public amenity, specifically regarding the design of the site access junction and the functionality of the proposed linear open space on steeply sloping topography.
