The proposed development will consist of: The removal of condition 7 of planning permission 73/1155 relating to a sterilisation agreement in so far as it relates to the current application site. A detached single-storey dwelling and single-storey domestic garage along with ancillary development consisting of vehicular access adjacent to the access to existing dwelling, on-site treatment system with associated sand polishing filter, driveway, parking space, landscaping, boundary treatment and associated site works
Core Refusal Reason
The application was refused due to unsuitable site conditions for wastewater treatment (high water table and flood risk) and the potential for the development to exacerbate excessive housing density, thereby eroding the rural character of transitional lands.
Decision Maker's Conclusion
- The proposed wastewater treatment system is located in a flood-prone or seasonally waterlogged area with poor percolation, posing an unacceptable risk to human and environmental health.
- The development would exacerbate an excessive density of one-off housing in a rural area, contributing to the erosion of rural character and contravening policies designed to protect transitional lands.
- The proposal fails to demonstrate that the receiving environment has the capacity to absorb further residential development without significant negative environmental and visual impacts, contrary to the Kildare County Development Plan 2023-2029.
