Core Planning Reasoning
The Inspector recommended that permission be granted but that the financial contribution conditions be amended. The development was deemed commercial in nature due to the corporate status of the applicant and the intended occupant, but a specific portion (the external covered yard) was found to qualify for a reduced 'open storage' rate under both the Section 48 and Section 49 schemes.
Decision Maker's Conclusion
- The proposed structures constitute 'port operational buildings' used for commercial purposes, meaning they are liable for contributions under both the Section 48 and Section 49 schemes.
- Condition No. 2 (Section 48) must be amended to apply a reduced rate of one-third the commercial rate for the external covered yard (390.07sqm), as it functions as open storage/hard-surfaced commercial space.
- Condition No. 3 (Section 49) should also be amended to apply the same reduced rate for the yard area and to reflect the full new floor area of 5,439sqm, as the Section 49 scheme does not provide for deductions for demolished floor area.
