Retention of works carried out for the demolition of an existing ground and first floor annex to the rear of the house; including the removal of an existing rusted metal panel driveway entrance gate as located off the side laneway; and for the retention of a new constructed ground and first floor annex including a new galvanised metal driveway entrance gate to replace the old gate. The newly constructed ground and first floor rear annex extension is intended for use as a separate flat including a dedicated private amenity patio. This flat is in addition to the already existing subdivision of the house into 5 separate flats. Permission is sought for alteration to the, as constructed new replacement driveway gate in order to make provision to include a new pedestrian entrance gate; Permission is sought for the installation of a new metal safety balcony to the rear elevation of the house at first floor level; similar to the existing balconies located at upper floors above. The four storey terrace house is listed on the record of Protected Structures (RPS Ref.2312).

The proposed development is recommended for grant as it is considered appropriate to the scale and character of the area and would not seriously injure the amenities of adjoining properties or the integrity of the Protected Structure, subject to the omission of the first-floor balcony.
Decision Maker's Conclusion
- The retention of the rear annexes is acceptable as they do not contain directly opposing windows and are sufficiently removed (c.4.2m) from the appellant's bedroom window to avoid being overbearing.
- The proposed first-floor metal safety balcony must be omitted as it adds visual clutter to the rear facade of the Protected Structure and would set an undesirable precedent for the terrace.
- The site is located within a zone of archaeological potential, but an Archaeological Assessment satisfied the Council that the works undertaken are unlikely to have impacted significant resources.
