(i) retention and completion of alterations and extensions to dwelling under construction - referred to as the Upper House (change of plan to that permitted under Pl.Reg.No. 18/4146), (ii) retention and completion of minor elevation changes to dwelling under construction - referred to as the Lower House (change of plan to that permitted under Pl.Reg.No. 18/4146), (iii) retention and completion of garage to serve both dwellings including roof terrace with 1.8m high screen on the west elevation and (iv) retention and completion of external steps with lift and associated site works.
Core Refusal Reason
The proposed alterations and extensions would cause significant unacceptable harm to the residential amenities of adjacent properties, conflicting with County Development Plan objectives regarding design standards and amenity protection.
Decision Maker's Conclusion
- The retention and completion of the ground level extension and garage with roof terrace deviate unacceptably from the design previously permitted under ABP 301779-18.
- The proximity and specific design features of the scheme would result in significant harm to the residential amenities and enjoyment of neighboring properties.
- The development fails to comply with Objective ZU 18-9 of the County Development Plan 2022, which mandates that new developments must respect existing areas and protect residential amenity.
