Failure to submit a required Appropriate Assessment Screening Report within the statutory timeframe, preventing the Planning Authority from assessing potential impacts on European sites.
Decision Maker's Conclusion
- The applicant failed to comply with a formal request for an Appropriate Assessment Screening Report within the mandatory four-week period prescribed by Article 45(3) of the Planning & Development Regulations 2001.
- In the absence of adequate environmental information, the Planning Authority is unable to screen out potential significant impacts on the Blackwater River SAC and Great Island Channel SAC.
- The Planning Authority is legally prohibited from extending the duration of the permission under Section 42(8) of the Planning & Development Act 2000 without a completed Appropriate Assessment screening.
