Core Planning Reasoning
The Inspector recommended granting permission (reversing the 'refusal' premise in the prompt) as the development is consistent with the 'Existing residential/Mixed Residential and Other Uses' zoning objective in the Cork County Development Plan 2022-2028, provides appropriate density for an inner suburban/infill site, and includes acceptable temporary infrastructure to manage wastewater constraints.
Decision Maker's Conclusion
- The proposed development is consistent with the Cork County Development Plan 2022-2028 and national guidelines for sustainable residential development, providing a suitable density of 38.3 units per hectare on zoned lands.
- The design and layout adequately respect the amenities of adjoining properties, with sufficient separation distances and boundary treatments to prevent undue overlooking or overbearing impacts on neighboring agricultural and residential lands.
- The use of a temporary wastewater treatment plant is a justified interim measure to address current capacity constraints in the Midleton network, provided it is decommissioned upon the completion of planned public infrastructure upgrades.
