Core Planning Reasoning
The Inspector recommended amending Condition No. 2 to reduce the development contribution, concluding that the majority of the extension qualifies for an exemption as a non-profit community facility, while the remaining commercial cafe portion is entitled to a floor space offset for demolished structures under the Development Contribution Scheme.
Decision Maker's Conclusion
- The sports club facility (excluding the cafe) qualifies for an exemption under Section 10 of the Development Contribution Scheme as it is a not-for-profit social and recreational development.
- The 42 sq. m commercial cafe is a for-profit use and does not qualify for the Section 10 exemption.
- Under Section 11 of the Scheme, the applicant is entitled to offset the 29.4 sq. m of demolished floor space against the new commercial area, resulting in a net additional floor area of 12.6 sq. m for levy purposes.
