SD21A/0293

Construction of a detached, three bedroom dwelling at the vacant garden plot to include dishing of existing footpath and kerb finishes allowing for vehicular access across the site boundary to enable the provision of 1 off-street parking space and all associated site works.

Refused

Core Refusal Reason

The proposed development would result in substandard private open space for both the existing house and the proposed dwelling, failing to meet the minimum 60sqm requirement set out in the South Dublin County Development Plan, thereby materially contravening residential amenity standards.

Decision Maker's Conclusion

  • The private open space provided for both the existing and proposed houses (46sqm and 29sqm respectively) falls significantly short of the 60sqm requirement, and the applicant's inclusion of side-passage/parking areas in their calculation is not acceptable.
  • While the proposed internal floor area of 92.35sqm is considered acceptable and meets the general standards for a three-bedroom house, this does not outweigh the deficiencies in external amenity space.
  • The proximity of the proposed structure to the boundaries of 37 and 37A Montpellier View would create a perception of overbearing and negatively impact the residential amenity of those adjoining properties.
