Known as the 'Marina Market' access to the north is through the existing access at Kennedy Quay. Access to the South is via the existing access on Centre Park Road and access to the west is via the existing access at Marina Walk.
Core Refusal Reason
The development was refused due to inadequate road infrastructure on Kennedy Quay posing a traffic hazard and the site's inappropriate location within a COMAH (Control of Major Accident Hazards) zone.
Decision Maker's Conclusion
- The current road infrastructure on Kennedy Quay is insufficient to accommodate the increased pedestrian, cyclist, and vehicular volumes, creating a significant risk of traffic hazard and conflict.
- The site falls within the Middle Land Use Planning Zone of a neighboring COMAH establishment (Gouldings Chemicals Ltd), where the proposed sensitivity level 3 development is deemed inappropriate.
- The Health and Safety Authority (HSA) advised against granting permission as the total floor space exceeds 5,000m2, posing a serious risk to human health in the event of a major accident.
